Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the StockFisher mobile application and website (together, the “Service”), provided by StockFisher (“StockFisher”, “we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Important — not financial advice. StockFisher is an information and alerting tool. It is not a broker, investment adviser, or financial advisor, and it does not execute trades. Nothing in the Service — including alerts, charts, price history, AI-generated stock reports, or any other content — constitutes investment, financial, legal, or tax advice, or a recommendation, offer, or solicitation to buy or sell any security. You are solely responsible for your own investment decisions. Always do your own research and consider seeking advice from a licensed professional. Investing involves risk, including the possible loss of principal.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you represent that you meet these requirements.
2. The Service
StockFisher lets you track stocks across supported markets, receive price-drop and boost alerts based on thresholds you choose, view charts and price history, and generate AI-powered research reports, subject to your subscription plan. We may add, change, or remove features at any time.
3. No warranty on data or accuracy
Market data, prices, and other information are obtained from third-party sources and may be delayed, incomplete, or inaccurate. AI-generated reports are produced automatically and may contain errors or omissions. We do not warrant the accuracy, completeness, timeliness, or reliability of any content, and you should not rely on it as the sole basis for any decision.
4. Your account
- You are responsible for maintaining the confidentiality of your login and for all activity under your account.
- You agree to provide accurate information and to keep it up to date.
- Notify us promptly of any unauthorised use of your account.
5. Subscriptions, billing, and trials
- Plans. We offer a free plan and paid plans (currently Basic and Pro), available on monthly or annual billing. Current features and prices are shown in the app and on our website and may change.
- Free trial. Paid plans may include a free trial. Unless you cancel before the trial ends, the plan converts to a paid subscription and the applicable fee is charged.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time; access continues until the end of the current paid period.
- Payments. Payments are processed by our payment processor (e.g. Stripe) or, for purchases made through a mobile app store, by Apple or Google under their terms.
- Price changes. We may change prices; changes apply to future billing periods and we will give reasonable notice where required.
- Refunds & withdrawal. Except where required by law, fees are non-refundable. If you are an EU consumer, you may have a statutory 14-day right of withdrawal; by starting a paid digital service (including a trial that converts) you may agree that performance begins immediately, which can affect that right. App-store purchases are subject to the store’s refund policy.
6. Acceptable use
You agree not to:
- Use the Service unlawfully or in breach of these Terms.
- Copy, scrape, resell, or redistribute data or content from the Service without permission.
- Reverse engineer, interfere with, or attempt to gain unauthorised access to the Service or its systems.
- Introduce malware or place an unreasonable load on our infrastructure.
7. Intellectual property
The Service, including its software, design, text, and branding, is owned by StockFisher or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use. Third-party market data remains the property of its providers.
8. Third-party services
The Service relies on and links to third-party services (such as authentication, payments, market data, and notifications). Your use of those services may be subject to their own terms, and we are not responsible for them.
9. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free. This section does not limit rights that cannot be excluded under applicable consumer law.
10. Limitation of liability
To the maximum extent permitted by law, StockFisher and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or investment losses, arising from or related to your use of (or inability to use) the Service. To the extent liability cannot be excluded, our total liability is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including mandatory consumer rights.
11. Indemnification
You agree to indemnify and hold StockFisher harmless from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service or breach of these Terms, to the extent permitted by law.
12. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or misuse the Service. On termination, your right to use the Service ends; sections that by their nature should survive (including intellectual property, disclaimers, and limitation of liability) will continue to apply.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here with a new “Last updated” date and, where the changes are material, provide reasonable notice. Continued use of the Service after changes take effect means you accept them.
14. Governing law and jurisdiction
These Terms are governed by the laws of Spain, without regard to conflict-of-law rules. Disputes will be subject to the competent courts of Spain. If you are a consumer, you may also benefit from mandatory protections of the law of your country of residence, and you may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
15. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a right is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service.
